You’ve decided to buy a home or cottage!
Buying a home/cottage is more then just looking at them. It’s finding the right home/cottage, in the right location and of course for the right price. Hopefully, with a minimum amount of time and inconvenience. The best way to achieve this is to work with a professional realtor who understands all of your wants and needs, your time frame and the financial boundaries to work within.

Selecting a Real Estate Agent( sales representative)
It is important that the salesperson understands your needs. A good salesperson will define your needs before they start to show you a home/cottage. They will find out all the important details to help you locate that perfect property just for you. A salesperson has access to M.L.S listings on a daily basis.
Let the Real estate agent do the work for you. Once you have contacted a salesperson the search can begin to locate your dream property, that salesperson will commit time to you if you will commit loyalty to them. If you play the field, you cannot expect undivided attention.

Who’s working for you?
It is important that you understand who the realtor is working for. For example both the seller and the buyer may have their own agent which means they each have a REALTOR who is working for them.

Or, some buyers choose to contact the seller’s agent directly. Under this arrangement the REALTOR is working for the seller, and must so what is best for the seller, but may provide many valuable services to the buyer.

A REALTOR working with a buyer may even be a “sub-agent” of the seller. Under sub agency, both the listing agent and the co-operating agent must so what is best for the seller even though the sub-agent may provide many valuable services to the buyer.

If the seller and the buyer have the same agent, this is dual agency and the REALTOR is working for both the seller and the buyer.

CODE OF ETHICS
REALTORS believe it is important that the people they work with understands their agency relationship. That’s why agency disclosure is included in a self imposed Code of Ethics which is administered by the Real Estate Council of Ontario. The code requires REALTORS to disclose in writing the nature of the services they are providing and encourages REALTORS to obtain written acknowledgement of that disclosure. The code also requires REALTORS to enter into a written agency agreement with any seller or buyer they are representing

BUYERS AGENT
A real estate company acting as a “buyer agent” must do what is best for the buyer.
A written contract, called the buyers agency agreement establishes buyer agency. It also explains services the company will provide, establishes a fee arrangement for the REALTOR’s services and specifies what obligations a buyer may have.

DUAL AGENT
Occasionally a real estate company will be the agent for both the buyer and the seller. The buyer and seller must consent to this arrangement in their listing and buyer agency agreements. Under this “dual agency”
arrangement, the company must do what is best for both the buyer and the seller:
Since the company’s loyalty is divided between the buyer and the seller who have conflicting interests, it is absolutely essential that a dual agency relationship be established in an agency agreement. This agreement specically describes the rights and duties of everyone involved and any limitations to those rights and duties.

BUYER AGENCY AND BUYER AGENCY AGREEMENTS

What is it? Why? What does it mean to YOU.

The Real Estate Council of Ontario, in their new Code of Ethics, commencing January 1, 2000, has now made it mandatory for ALL Real Estate Agents in Ontario to enter into Written Representation Agreements (both with Sellers and Buyers) at the earliest possible time. Thus BUYER AGENCY AGREEMENTS.

CUSTOMER vs CLIENT – The difference is extremely important. As a “CLIENT” – The Agent owes YOU the HIGHEST LEVEL of FIDUCLIARY DUTIES – competence, diligence, FULL DISCLOSURE, obedience, loyalty, CONFIDENTIALITY, and full accounting. The Agent SHALL endeavor to protect and promote YOUR best interests.

AS a “CUSTOMER” – Agents must only deal Fairly, Honestly and with Integrity and not mislead YOU about a property transaction.

WRITTEN REPRESENTATION AGREEMENTS ARE NOW MANDATORY IF YOU ARE GOING TO BE REPRESENTED AS A “CLIENT”. If a Buyer won’t agree to a Buyer Agency Agreement, then he/she can only be treated as a CUSTOMER and therefore, CONFIDENTIALITY IS OUT THE WINDOW. Any information gathered from the BUYER MUST be divulged to the SELLER- ie. How much the BUYER is willing to pay for the Property.

According to Aland Johnston, Mgr. Of complaints, compliance and discipline at The Real Estate Council of Ontario, “It is in the buyer’s best interest to sign a representation agreement.

As a “CLIENT” we can ADVISE YOU about values, things to watch out for/concerns (shore road allowance, septic, etc.), negotiation strategies, conditions in Offers, etc. We look out for YOUR BEST INTERESTS. As a “CUSTOMER” we must only provide you with information without advice.

We only ask that you work with us in OUR AREA, for NINETY DAYS. If you choose to look in another area, eg. Haliburton, you should seek an agent there.

If other Agents are not discussing this with you, BE ASSURED, they are not working for YOU. It’s the LAW.
